Your formula could be clean. Your heavy metal panel could be pristine. But if the D&C Red No. 7 lake your contract manufacturer sourced for your lipstick line doesn’t have an FDA batch certificate tied to that specific production lot, your finished product is legally adulterated under 21 USC 361 — not “potentially non-compliant,” not “a documentation gap.” Adulterated.

That distinction — between a color additive being listed as permitted and having its specific batch certified by FDA — is the compliance gap that catches cosmetic brands every year. It shows up most painfully when a retailer compliance team or an FDA inspector asks to see supply chain documentation, and the answer is some variation of “our supplier said it was fine."

"Approved” and “Certified” Are Two Separate Things

Federal law treats color additives differently from most other cosmetic ingredients. Under the FD&C Act, a color additive must receive pre-market FDA approval before anyone can use it commercially. That approval is codified in the listings under 21 CFR Parts 73 and 74. But for the synthetic organic dyes covered by Part 74, approval is only the first gate. Every batch produced must also be individually certified by FDA — meaning a sample from each production lot is tested by the agency before that dye can be sold or used in any cosmetic.

Think of the Part 74 listing as the permanent permit authorizing a dye for use. The batch certificate is the entry clearance for each specific shipment.

FDA’s Office of Cosmetics and Colors (OCAC) runs the certification program. The color additive manufacturer submits a sample from each production lot along with the required fee. FDA runs analytical testing against the specifications in the relevant Part 74 monograph — confirming identity, checking purity, and verifying that heavy metal impurities fall within prescribed limits. If the lot passes, FDA issues a numbered certificate tied to that specific lot. That certificate is supposed to travel with the dye through the supply chain to the cosmetic manufacturer.

The cosmetic brand is responsible for ensuring the colorants in their formula carry valid, lot-matched certificates. Under 21 USC 361(e), any cosmetic containing a color additive that hasn’t been certified per Section 721 of the FD&C Act is adulterated by operation of law. There’s no good-faith defense built in.

The Two Categories Every Formulator Needs to Know Cold

Not every colorant requires batch certification. The system splits into two tracks, and knowing which track your dyes are on is non-negotiable.

Colors exempt from certification are listed in 21 CFR Part 73. These are predominantly inorganic mineral pigments: iron oxides (black, red, and yellow — the foundation and blush workhorses), titanium dioxide, mica, ultramarines, chromium hydroxide green, chromium oxide greens, ferric ammonium ferrocyanide, and manganese violet, among others. These ingredients are still regulated — each has specific purity limits and permitted use restrictions within its Part 73 listing — but FDA doesn’t batch-certify them. A supplier’s certificate of analysis and, ideally, a third-party purity test from an accredited cosmetic testing laboratory covers what you need.

Colors subject to batch certification are listed in 21 CFR Part 74. These are the synthetic organic dyes and their aluminum lakes. The list includes:

  • FD&C Red No. 40 (Allura Red) and its aluminum lake
  • FD&C Blue No. 1 (Brilliant Blue) and its aluminum lake
  • FD&C Yellow No. 5 (Tartrazine) and its aluminum lake
  • FD&C Yellow No. 6 (Sunset Yellow) and its aluminum lake
  • D&C Red No. 6, No. 7, No. 17, No. 21, No. 22, No. 27, No. 28, No. 30, No. 33, No. 34, No. 36
  • D&C Orange No. 5 and No. 10
  • D&C Yellow No. 10 and No. 11
  • D&C Violet No. 2
  • D&C Green No. 5 and No. 6

These synthetic dyes appear across lip color, pressed powder, liquid foundation, eyeliner, nail lacquer, and hair color. D&C Red No. 7 lake alone is found in hundreds of lipstick SKUs at every price point. D&C Red No. 6 and its lake are similarly ubiquitous. If your formula contains any dye from this list, the certification chain must be intact — lot-by-lot, shipment-by-shipment.

What FDA Is Actually Testing When It Certifies a Batch

When OCAC receives a certification submission, the analysis goes beyond confirming the dye’s identity. Each Part 74 monograph specifies the complete analytical profile the batch must satisfy. For most certified synthetic organic dyes, that includes:

Identity and assay. Confirming the correct molecular structure and quantifying total color content. Most dye monographs specify a minimum purity — commonly ≥ 85% total color for pure dye forms — with the remainder accounted for by subsidiary dyes and manufacturing impurities.

Subsidiary dyes. Limits on structurally related byproducts that form during synthesis. These are set because they can have different safety profiles than the primary dye.

Heavy metal impurities. The limits vary by colorant but are meaningful. For FD&C Red No. 40 under 21 CFR §74.340, lead must be ≤ 10 ppm and arsenic ≤ 3 ppm. Most certified synthetic dyes carry mercury limits of ≤ 1 ppm. These aren’t aspirational thresholds — they’re the specifications FDA tests against before signing the certificate.

Water-insoluble matter and ether-extractable matter. Additional purity markers that reflect manufacturing process control.

When your supplier hands you a batch certificate, the lot number on that document must match the lot number on the shipping container. Mismatches aren’t administrative errors — they indicate the certificate and the product you received may not be for the same material.

Where a Cosmetic Testing Laboratory Fits In (And Where It Doesn’t)

A third-party cosmetic testing laboratory cannot issue FDA batch certificates. That authority sits exclusively with FDA. But there’s genuine analytical value a qualified lab provides that the batch certificate alone doesn’t cover.

Incoming colorant identity verification. Using HPLC or UV-Vis spectrophotometry, a lab can confirm that the dye your supplier shipped matches the declared color additive and is what the certificate claims it is. This matters especially for aluminum lakes, which are visually indistinguishable from one another and sometimes from non-permitted analogs.

Prohibited colorant screening. Not every colorant used globally is FDA-approved. Imports from suppliers in markets with different regulatory frameworks have introduced non-permitted dyes including malachite green, sudan dyes (Sudan Red, Sudan Orange, Sudan Black), rhodamine B, and others. FDA import screening has flagged cosmetics containing these substances. A screening panel run at a certified cosmetic testing laboratory before production provides documented protection — and a paper trail if questions ever arise.

Finished formula heavy metal profiling. Your batch certificate shows the heavy metal content of the raw synthetic dye. It says nothing about the cumulative load once that dye is combined with other formula components. If your pressed highlighter includes mica, iron oxides, and a certified synthetic lake, the total lead and arsenic exposure to the consumer comes from all three sources. Testing the finished product via ICP-MS — particularly for lip products with higher ingestion exposure — gives you data the batch certificate never will.

Supplier qualification and incoming QC. For brands building testing programs that align with ISO 17025 principles, running an analytical panel on each incoming lot of Part 74 colorants creates a defensible audit trail beyond “we received a certificate.”

None of this work replaces certification. The two layers address different things. Certification establishes the regulatory status of the dye batch. Third-party analytical testing establishes what’s actually in your materials and finished product. Both matter.

Why Imported Color Additives Are the Highest-Risk Supply Chain Scenario

Finished cosmetics and colorant raw materials imported from overseas are where color additive non-compliance concentrates. The structural reason is straightforward: many overseas colorant manufacturers — even reputable ones in their home markets — haven’t submitted their production lots to FDA for certification. They hold regulatory standing in the EU, in China, in South Korea, but not the US batch certificate.

From an aesthetic and formulation standpoint, a D&C Red No. 7 lake produced in a facility that’s never submitted to OCAC looks identical to a certified lot. Color, particle size, dispersibility — all the same. The difference is entirely in the paper trail.

FDA’s import screening programs have long targeted cosmetics for color additive violations, and the regulatory environment has tightened considerably since the Modernization of Cosmetics Regulation Act (MoCRA) was signed into law on December 29, 2022. MoCRA gave FDA recall authority over cosmetics for the first time — authority it lacked entirely under the prior framework. Combined with the facility registration and product listing requirements that phased in through 2023 and 2024, FDA now has substantially better visibility into the supply chain.

If you’re sourcing finished cosmetics or raw colorants internationally, the burden of verifying batch certification falls on you as the US responsible person. The time to do that verification is before the shipment clears customs — not after you’re in distribution and someone asks a question.

Building a Color Additive Verification Program That Holds Up

This doesn’t require a sophisticated system. What it requires is deliberate process applied consistently.

  1. Audit your formula’s complete colorant list against 21 CFR Parts 73 and 74. Every synthetic dye from Part 74 needs a batch certificate in your documentation file — no exceptions.
  2. Require lot-specific FDA batch certificates from your colorant supplier on every purchase order. The lot numbers must match the containers you receive.
  3. Send incoming colorant samples to a cosmetic testing laboratory for identity confirmation and heavy metal testing, particularly for new suppliers, new country-of-origin, or new lots from existing suppliers.
  4. Run a prohibited colorant screen on any finished cosmetics sourced internationally before they enter distribution.
  5. Test your finished formulation’s total heavy metal profile for any product category with elevated ingestion or eye-area exposure — lip color, lip gloss, and eye products especially.

That last step is where many brands draw the line too early. The certified dye may fully satisfy its individual Part 74 limits, but cumulative load from multiple formula components can still produce a finished product profile worth examining — particularly as retailers and marketplace platforms increase the depth of their compliance documentation requests.
